Terms & Conditions

Website Terms and Conditions

These Terms and Conditions govern the purchase and use of background screening and verification services provided by PeopleCheck.

By purchasing a service through our website, you agree to these Terms and Conditions. Certain services purchased under separate enterprise or bulk screening agreements may be subject to different contractual terms.

1. Our Services

PeopleCheck provides background screening and verification services to businesses, organizations and individuals.

Services may include criminal record checks, employment and education verification, professional reference checks, Social Media Checks and Comprehensive Online Media Checks.

Each screening is limited to the scope of the service purchased and is subject to applicable legal, consent and verification requirements.

2. Orders and Payment

All online screening orders must be paid for before processing begins, unless alternative payment arrangements have been approved by PeopleCheck.

Prices are displayed in Canadian dollars unless otherwise stated. Applicable taxes and additional charges will be disclosed before payment.

Purchasers are responsible for providing accurate billing, contact and screening information.

3. Purchaser Responsibilities

Purchasers must request screening services only for lawful and authorized purposes.

Organizations purchasing screening services for candidates are responsible for informing those individuals of the proposed screening and ensuring they have appropriate permission to provide their contact information to PeopleCheck.

Purchasers are responsible for the accuracy of the information they submit and for using screening results in compliance with applicable laws.

4. Candidate Consent and Participation

PeopleCheck requires the appropriate authorization or other lawful basis before conducting screening activities.

Candidates may decline to participate or withdraw consent in accordance with applicable law.

Where a candidate refuses screening, withdraws consent or fails to provide required information, PeopleCheck may be unable to complete the requested service.

5. Candidate Application Deadlines

Candidates have 21 calendar days from the date the initial screening invitation is successfully issued to complete the required application and authorization.

PeopleCheck may approve extensions at its discretion.

Applications that remain incomplete after the applicable deadline may be closed without a completed screening report.

6. Candidate Information Corrections

Purchasers are responsible for providing accurate candidate contact information.

PeopleCheck may permit corrections for the originally designated candidate, subject to verification and approval.

Corrections do not permit substitution of another candidate and do not automatically restart or extend the original 21-day application period.

7. Candidate Substitutions

Once a screening invitation has been issued to the designated candidate, the screening request cannot be transferred or reassigned to another individual.

A new screening order is required for a different candidate.

8. Cancellations and Account Credits

PeopleCheck operates on a credit-first basis.

Where a purchaser cancels an order before screening work begins, the candidate invitation is issued or third-party costs are incurred, PeopleCheck will provide a full account credit toward future eligible screening services.

Once a screening invitation has been issued, no refund or account credit will be provided due to candidate non-response, refusal to participate, failure to provide required information or withdrawal of consent, except where required by applicable law.

Credits issued for standard online purchases are valid for 12 months from issuance, where legally permissible.

Credits are not redeemable for cash except where required by law.

Enterprise and bulk screening arrangements may have different credit terms established through a separate written agreement.

Nothing in these Terms and Conditions limits a purchaser's mandatory statutory cancellation, refund or other consumer rights.

9. Missing or Incomplete Information

PeopleCheck may request additional information, clarification or documentation necessary to complete a screening.

A reasonable deadline may be established for providing the requested information.

Where the required information is not received, PeopleCheck may suspend or close the affected screening or issue a report identifying applicable limitations.

Failure to provide required information does not automatically entitle the purchaser to a refund or account credit, subject to applicable law.

10. Screening Processing Times

Screening processing times vary depending on the service requested, candidate participation, information availability and third-party responsiveness.

PeopleCheck does not guarantee specific completion timeframes unless expressly agreed in writing.

Estimated processing times may be provided upon request and are subject to change.

11. Third-Party Verification

Certain screening services depend on information supplied by independent third parties, including employers, educational institutions and professional references.

PeopleCheck undertakes reasonable verification efforts but cannot guarantee that independent sources will respond or provide the requested information.

Where required verification efforts have been completed but the source does not respond, no refund or account credit will ordinarily be provided, subject to applicable law.

12. Additional Screening Fees

Some screening services may require additional third-party fees or processing charges.

PeopleCheck will disclose additional charges and obtain purchaser approval before proceeding.

Where the purchaser declines the additional charges, PeopleCheck may complete the available screening scope or close the affected service, as appropriate.

Declining additional charges does not automatically entitle the purchaser to a refund or account credit, subject to applicable law.

13. Accuracy and Limitations of Screening Information

PeopleCheck exercises reasonable care in collecting, verifying and reporting information within the scope of the purchased service.

Screening results may rely on independent third-party information that is incomplete, inaccurate or outdated.

PeopleCheck cannot guarantee the accuracy or completeness of all independent sources.

Reports reflect information reasonably available at the time of screening and should be considered alongside any identified limitations.

14. Social Media and Online Media Screening

Social Media Checks and Comprehensive Online Media Checks are limited to lawfully accessible public information within the scope of the purchased service.

PeopleCheck does not require access to private social media accounts or candidate passwords.

Publicly available information may be incomplete, outdated or incorrectly attributed. PeopleCheck takes reasonable steps to assess identity matching and relevance before reporting findings.

Online media screening does not constitute a criminal record check.

15. Screening Reports and Confidentiality

Screening reports purchased by businesses or organizations are provided exclusively to the authorized purchaser and designated users with appropriate access permissions.

Reports may contain confidential third-party information, including professional references, assessments and information provided by independent sources.

PeopleCheck takes reasonable measures to protect the confidentiality of screening information, subject to applicable law.

For screening services purchased by individuals for themselves, reports will ordinarily be provided to the individual purchaser, subject to applicable service requirements and restrictions.

16. Use and Sharing of Screening Reports

Screening reports may be used only for the lawful and authorized purpose for which they were requested.

Organizational purchasers may share reports internally with authorized personnel who require access for that purpose.

External disclosure requires appropriate authorization and a lawful basis.

Purchasers are responsible for protecting screening reports against unauthorized access, use or disclosure.

17. Screening Report Availability

Completed screening reports will remain accessible through the PeopleCheck online portal for 12 months from the date of completion.

Purchasers are responsible for securely downloading and retaining reports they require for lawful purposes during this period.

After 12 months, reports may no longer be accessible through the portal. PeopleCheck may retain records for longer periods where necessary to meet applicable legal, regulatory or operational requirements, in accordance with its Privacy Policy.

18. Responsibility for Screening Decisions

PeopleCheck provides background screening and verification information. It does not make hiring, promotion, retention or other employment decisions or recommendations regarding a candidate's overall suitability.

Purchasers are solely responsible for evaluating screening results and making employment, engagement or other decisions.

Purchasers must ensure that their use of screening information complies with applicable employment, human rights, privacy and other relevant legislation.

19. Screening Result Disputes and Corrections

PeopleCheck will review concerns regarding the accuracy or completeness of screening information.

Confirmed errors will be corrected at no additional charge, and corrected information will be provided to authorized recipients where appropriate.

Requests for additional screening or verification outside the original purchased scope may be subject to additional fees, disclosed before the work begins.

20. Service Errors and Corrections

Where an error attributable to PeopleCheck materially affects a screening, PeopleCheck will take reasonable steps to correct the error or repeat the affected screening at no additional charge.

Where correction or repetition is not possible, PeopleCheck may offer an appropriate account credit or other resolution.

Refunds and other remedies will be provided where required by applicable law.

21. Account Security

Purchasers are responsible for maintaining the confidentiality of their account credentials and ensuring that access to their accounts and screening reports is limited to authorized individuals.

Suspected unauthorized access or security concerns should be reported promptly to PeopleCheck.

22. Payment Disputes and Chargebacks

Purchasers are encouraged to contact PeopleCheck regarding billing concerns.

Where a payment is disputed or a chargeback is initiated, PeopleCheck may investigate the transaction and provide relevant supporting documentation to its payment processor or financial institution.

PeopleCheck may temporarily suspend new screening orders during an unresolved payment investigation where reasonable and legally permitted.

Nothing in this section restricts lawful payment dispute or consumer protection rights.

23. Refusal or Discontinuation of Services

PeopleCheck may refuse, suspend or discontinue a screening request where there are reasonable concerns involving unlawful use, inadequate authorization, materially misleading information, privacy or security risks, or material violations of these Terms and Conditions.

PeopleCheck may request additional information before proceeding and will communicate its decision where appropriate.

Any applicable refund, credit or other remedy will be determined in accordance with these Terms and Conditions and applicable law.

24. Limitation of Liability

To the maximum extent permitted by applicable law, PeopleCheck's total liability arising from or relating to a purchased screening service will be limited to the amount paid for the specific service giving rise to the claim.

PeopleCheck will not be liable for indirect, incidental, consequential or special damages, including lost profits or business opportunities, to the extent such exclusions are legally permitted.

These limitations do not exclude or restrict liabilities that cannot lawfully be limited.

Separate enterprise or bulk screening agreements may establish different liability provisions.

25. Privacy and Personal Information

PeopleCheck collects, uses, discloses, safeguards and retains personal information in accordance with its Privacy Policy and applicable privacy legislation.

Additional information regarding personal information practices, privacy rights and privacy-related inquiries is available in PeopleCheck's Privacy Policy.

26. Changes to Terms and Conditions

PeopleCheck may update these Terms and Conditions from time to time.

Changes will be published on the website with an updated effective date and will generally apply to new purchases made after that date.

Existing purchases will remain subject to the terms applicable when the order was placed, subject to applicable law and any validly agreed amendments.

Separate enterprise or bulk screening agreements will continue to be governed by their contractual provisions.

27. Governing Law

These Terms and Conditions are governed by the applicable laws of Ontario and the federal laws of Canada applicable therein, without limiting any mandatory rights or protections available to purchasers under other applicable laws.
